29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    a)  On and or about 03-12-15 at Streblow Drive in Fond du Lac, the employer failed to provide adequate eye protection for four employees working with hand held power tools.  Two employees were performing framing work using a pneumatic nail gun and electric saw and two employees were working on the roof with a nail gun and electric saw.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a)  On and or about 03-12-15 at Streblow Drive in Fond du Lac, employees performing roofing work in excess of seventeen (17) feet above surface level with unprotected sides and edges were not protected from falling with conventional fall protection equipment at all work areas.  Employees were working from on top of a bunk of materials staged at the roof edge at approximately twenty-one (21) ft. above surface level and from the roof surface at the side of the bunk approximately eighteen (18) ft. above surface level without any fall protection equipment.    Steve Fisher Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 312559008, citation number02, item number001 and was affirmed as a final order on 12-23-2010, with respect to a workplace located at 1418 Angels Drive, Ledgeview, WI 54311.

29 CFR 1926.503(c)(3): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section:      a)  On and or about 03-12-15, the employer did not ensure two new employees had adequate knowledge to recognize fall hazards when walking/working from heights greater than six (6) feet.  The employees were installing a roof system from surfaces approximately 18 ft. and 21 ft. above surface level without utilizing fall protection equipment.    The Steve Fischer Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(c)(3), which was contained in OSHA inspection number 86297 (312560386), citation number 01, item number 01b and was affirmed as a final order on 04-26-2011, with respect to a workplace located at Evergreen Drive, Appleton, WI  54914.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:      a)  On and or about 03-12-15 at Streblow Drive in Fond du Lac, employees were stepping on the top of a six (6) ft. stepladder to access/egress a wall top plate surface.  The ladder was positioned on the second floor approximately 28 inches below the wall top plate used by employees as the access/egress route to the roof surface.    The Steve Fischer Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(13), which was contained in OSHA inspection number 86297 (312560386), citation number 01, item number 02a and was affirmed as a final order on 04-26-2011, with respect to a workplace located at Evergreen Drive, Appleton, WI  54914.
