29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.    a) 16 Wintergreen Ct., Jackson, NJ:  On or about March 12, 2015, the employer had not developed an accident prevention program, that provided for frequent and regular inspections of the job sites, work process, materials, and equipment, to be made by a competent person. As such, JO Construction LLC employees were conducting roofing activities without proper use of fall protection.  Additionally, ladders used to access the roof were found to be damaged and the rails did not extend three feet above the landing area.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet above the upper landing surface being accessed:    a) 16 Wintergreen Ct., Jackson, NJ:  On or about March 12, 2015, JO Construction LLC employees were conducting roofing activities on a two story single family home.  The rails of the two ladders used to access the roof did not extend three feet above the landing area.       NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects were not immediately marked " Defective, Do not Use" and withdrawn from service:  a) 16 Wintergreen Ct., Jackson, NJ:  On or about March 12, 2015, JO Construction LLC employees were conducting roofing activities on a two story single family home.  One of the ladders that the employees used to access the roof was noted to have a seriously bent rung.       NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   a) 16 Wintergreen Ct., Jackson, NJ:  On or about March 12, 2015, JO Construction LLC employees were conducting roofing activities without proper use of fall protection.  As such employees were exposed to a fall hazard of greater than 15 feet.      JO Construction LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 963093, citation number 01, item number 01 and was affirmed as a final order on 05/05/2014, with respect to a workplace located at 400 Old lacy Rd., Lakewood, NJ.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards.  a) 16 Wintergreen Ct., Jackson, NJ:  On or about March 12, 2015, JO Construction LLC employees were conducting roofing activities without proper use of fall protection and were exposed to a fall hazard of greater than 15 feet.  The employer had not trained each employee exposed to fall hazards to recognize the hazards and the procedures to be followed in order to minimize these hazards.  JO Construction LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(a)(1), which was contained in OSHA inspection number 983837, citation number 01, item number 02 and was affirmed as a final order on 10/08/2014, with respect to a workplace located at 65b Long Beach Blvd., Beach Haven, NJ.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
