29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. A machine operator, working in the 12 wire area, was exposed to a noise dose of 178.2%, or an equivalent dBA of 94.1 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 439 minutes during one shift on March 26, 2015. The employer did not have a continuing, effective hearing conservation program. b. A machine operator, working in the small 7 wire area, was exposed to a noise dose of 174.3%, or an equivalent dBA of 94.0 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 437 minutes during one shift on March 26, 2015. The employer did not have a continuing, effective hearing conservation program. c. A machine operator, working with the Watson Brand Stranding Machine #62, was exposed to a noise dose of 146.2%, or an equivalent dBA of 92.7 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 435 minutes during one shift on March 26, 2015. The employer did not have a continuing, effective hearing conservation program. d. A machine operator, working in the 30, 307, and 311 area, was exposed to a noise dose of 96.58%, or an equivalent dBA of 89.7 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 440 minutes during one shift on March 26, 2015. The employer did not have a continuing, effective hearing conservation program. e. A machine operator, working in the Dry Draw 907 area, was exposed to a noise dose of 85.94%, or an equivalent dBA of 88.9 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 423 minutes during one shift on March 26, 2015. The employer did not have a continuing, effective hearing conservation program.
