OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: OSH ACT of 1970 Section 5(a)(1):  Section 5(a)(1) of the OSH ACT establishes the employer's duty under the law to provide his or her employees a workplace free of recognized hazards which cause death or serious physical harm from being struck by an overhead hoist trolley while working in an elevated scissors lift.  (a)   The big head bay of the shop:  Employees were exposed to a hazard of being crushed under a falling scissors lift         due to an overhead hoist being operated in the same bay in close proximity to a scissors lift, in that the travel path of          the hoist was not checked to avoid personnel and obstructions.  (b)   The big head bay of the shop: Employees were exposed to a hazard of being crushed under a falling scissors lift          due to an overhead hoist being operated in the same bay and in close proximity to a scissors lift, in that the attention          of the hoist operator was diverted while operating the hoist.   Among other methods, feasible and acceptable means of hazard abatement include:  1)  Adopt language and enforce safety rules as outlined in "Hoist Manufacturer's Institute", 8720 Red Oak Blvd, Suite      201, Charlotte, NC 28217-3992, page 15 Hoist Operators Duties & Responsibilities; page 39:  The Operator :  Shall       not engage in any activity that will divert the attention of the operator.  2)  Adopt language and enforce safety rules outlined in ASME/ANSI standard B-30.2-2005, Chapter 2-3 Operation:       2-3.1.7  Conduct of Operators: a)  "The operator shall not engage in any practice that will divert attention while              actually engaged in operating the crane."  3)  Ensure hoist operators are properly trained by reviewing the Company Safety Policy written in Tank       Component Industries'  Employee Safety Policy Booklet, page 35, HOIST SAFETY , and page 36, under General Safety       Rules; Operators shall comply with the following rules while operating hoists:        *  " Do not engage in any practice that will divert your attention while operating the hoist."  4)  Develop a safety rule for hoist operators prohibiting listening to electronic devices while operating overhead hoists.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  (a)  In the big head bay of the shop;  the specific lockout procedure for overhead hoists operating in the bay did not include the provision to lock out the hoist when its operation could directly affect other employees working in the bay.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19
