CFR 1926.1402(b): The equipment was assembled or used without ensuring that ground conditions are firm, drained, and graded to a sufficient extent so that, in conjunction (if necessary) with the use of supporting materials, the equipment manufacturer's specifications for adequate support and degree of level of the equipment are met.  (a) On or about April 1, 2015, the employer did not ensure supporting material was incorporated and utilized, in the set-up of the American R213 crane, to prevent floats from displacement. The crane was not set-up on firm ground to ensure the crane maintained level, according to the manufacturer's specifications. This exposed employees to struck-by and crushing hazards.

29 CFR 1926.1402(c)(2): The user of the equipment and the operator were not informed of the location of hazards beneath the equipment set-up area (such as voids, tanks, utilities) if those hazards are identified in documents (such as site drawings, as-built drawings, and soil analyses) that are in the possession of the controlling entity (whether at the site or off-site) or the hazards are otherwise known to that controlling entity.  (a) On or about April 1, 2015, the employer did not ensure that the operator of the American R213 crane, was informed of the ground conditions, including but not limited to; milled pavement, concrete base, and the width of the roadway base. This exposed employees to struck-by and crushing hazards.
