29 CFR 1926.300(b)(1): When power operated tools were designed to accommodate guards, they were not equipped with such guards when in use.   a) At the project on or about March 30, 2015, outside the driveway concrete wall, there was no guard on a Makita right angle grinder used to smooth out concrete wall surface, exposing employees to the hazards of being struck by the wheel and broken dried small concrete pieces.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports:  a) At the project on or about March 30, 2015, the wooden scaffolding platform was not fully planked as there were 3 and 4 pieces of two by fours (or 2x4s) wide lumber on the 65-inch wide wooden scaffold.  The plank was about 12 feet, 6 inches above the ground level.  A mason used the scaffold to install a cement light pole, exposing the worker to a fall hazard.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration.  Such activities were not performed only by experienced and trained employees selected for such work by the competent person.   a) At the project on or about March 30, 2015, one wooden scaffold was erected, dismantled, and altered by employees not under the supervision and direction of a competent person qualified in erecting, dismantling, and altering wooden scaffolds.  The scaffold was hazardous in that the scaffold platform was not fully planked and there were no top and mid rails or other means of fall protection, exposing an employee to a 12 foot, 6 inch fall to the ground below.

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below, except on float (ship) scaffolds where an edging of 3/4 x 1 1/2 inch (2 x 4 cm) wood or equivalent may be used in lieu of toeboards:   a) At the project on or about March 30, 2015, one wooden scaffold was not installed with toeboards a minimum of four inches nominal in vertical height from its top edge to the level of the floor or platform.  Toeboards help prevent workers from slipping and falling off of raised surfaces by creating a raised edge that prevents workers from slipping.

Such machine, tool, material, or equipment was not either identified as unsafe by tagging or locking the controls to render them inoperable or by physically removing them from their place of operation:    a) At the project on or about March 30, 2015, a 110 VAC Makita right angle grinder was not identified as unsafe with a tag, by rendering it inoperative or by physically removing it from the project site.  The grinder was used to smooth out concrete wall.
