29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Jobsite: On or about April 2, 2015 and times prior thereto, employees performing sheathing work did not have a means of fall protection. Note: Abatement certification IS NOT required for this item. The Cuevas Framing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 98655, citation number 1, item number 1a and was affirmed as a final order on November 18, 2011, with respect to a workplace located at Lot 14, Blk 2 Promontory Ridge, Boise, ID 83706. 29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used: a) Jobsite: On April 2, 2015 and times prior thereto the responsible person on site and employees performing framing activities did recognize the hazards of sheathing a 6 in 12 pitch roof without any means of fall protection and take actions to minimize or eliminate these hazards.
