Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees operating the vertical compression bender were exposed to crushed-by hazards from improperly designed and equipped controls:         (a)  Crest Bending, Inc. 108 John Street, New Washington:  On or about March 27, 2015, the Sterling vertical compression bender #421 was not equipped with a manually resetting emergency stop.  The bender remained energized after the emergency stop control was pushed which permitted the unit to cycle.  This configuration exposed employees to caught in hazards and were at risk of sustaining an amputation injury.         (b)  Crest Bending, Inc. 108 John Street, New Washington:  On or about March 27, 2015, the Sterling vertical compression bender #422 was not equipped with a manually resetting emergency stop. The bender remained energized after the emergency stop control was pushed which permitted the unit to cycle.  This configuration exposed employees to caught in hazards and were at risk of sustaining an amputation injury.         (c)  Crest Bending, Inc. 108 John Street, New Washington:  On or about March 27, 2015, the Sterling vertical compression bender #421 was designed such that it was equipped with a moveable, foot-pedal and a moveable, pedestal-mounted start control.  Both the foot and the push-button start controls were operative at the same time.  This design exposed employees who were operating the bender to amputation injuries in that the unit could be unexpectedly started from the remotely located control.         (d)  Crest Bending, Inc. 108 John Street, New Washington:  On or about March 27, 2015, the Sterling vertical compression bender #422 was designed such that it was equipped with a moveable, foot-pedal and a moveable, pedestal-mounted start control.  Both the foot and the push-button start controls were operative at the same time.  This design exposed employees who were operating the bender to amputation injuries in that the unit could be unexpectedly started from the remotely located control.      Among other methods, a feasible abatement method to correct this hazard is to install emergency stop controls that require the employee to manually reset the control and to install a selector switch which would activate only one control station at a time, as referenced in ANSI B11.15-2001 (R2007), sections 6.12.2, Emergency stop, and 6.13, Operator control stations.
