29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition: 345 Rocus St, Springfield MA On April 20, 2014, three powered industrial trucks with inoperative emergency brakes were available for use. The deficient brakes were all annotated on their written Forklift Condition Reports. The condition of one truck was annotated on three daily reports over the previous ten days.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service, and were placed in service when the examination showed conditions adversely affecting the safety of the vehicle. Such examination was not made at least daily. Where industrial trucks are used on a round-the-clock basis, they were not examined after each shift. Defects when found were not immediately reported and corrected. 345 Rocus St, Springfield MA On April 20, 2015 and at times prior, supervisors and employees did not always examine powered industrial trucks for defects every shift when they were used on an around-the-clock basis. Additionally, three powered industrial trucks with inoperative emergency brakes were available for use. The deficient brakes were all annotated on their written Forklift Condition Reports. The condition of one truck was annotated on three daily reports over the previous ten days.
