29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) Polishing area: On or about April 23, 2015, the employer did not ensure the use of eye protection, such as, but not limited to safety glasses, for employee(s) who were exposed to eye hazards from flying particles and silica dust, which were generated during the use of a Makita 6-inch Angle Grinder (Model 9566CV, SN: 33050A) for granite dry polishing and grinding processes.   b) Polishing area: On or about April 24, 2015, the employer did not ensure the use of eye protection, such as, but not limited to safety glasses, for employee(s) who were exposed to eye hazards from flying particles and silica dust, which were generated during the use of a Makita 6-inch Angle Grinder (Model 9566CV, SN: 33050A) for granite dry polishing and grinding processes.

29 CFR 1910.134(c): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use:  Polishing area: On or about April 24, 2015, and times prior there to, the employer did not establish a written respiratory protection program or implement provisions of the program, such as but not limited to medical evaluations, fit tests, or selection and maintenance of respirators for employees who were required to wear 3M half-mask tight fitting respirators and N-95 filtering face piece respirators and were exposed to inhalation hazards in work areas where exposures to respirable crystalline silica were found to exceed the permissible exposure limit for an eight hour work shift.

Sample calculations include an assumed zero exposure for the  167 minutes not sampled.

Administrative and engineering controls were not in use to minimize employee exposures to respirable crystalline silica.
