29 CFR 1903.19(c)(1): The employer did not certify to OSHA within 10 calendar days after the abatement date that each cited violation had been abated:  a) Jobsite at 95 West Claire, Meridian Idaho: The employer, Melendez Construction, LLC, failed to provide certification and documentation that Repeat citations 1, item 1, from inspection number 1059546 was corrected.  The date by which this violation was to be corrected was May 22, 2015.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels are not protected by guardrail systems, safety net system, or personal fall arrest system:   a) The employer does not ensure that employees use fall protection when exposed to serious fall hazards during roofing work.  This condition was most recently observed at an existing residential job site, 95 West Claire, Meridian, Idaho, on April 28, 2015.  Employees performed re-roofing activities on a 6 in 12 pitched roof without a fall protection system in place.  This exposed the employees to fall hazards ranging from 9 to 15 feet from various locations on the roof to the concrete or ground below.   Jesus Lares was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 843463, citation number 1, item number 1, and was affirmed as a final order on June 13, 2013, with respect to a workplace located at 6907 Hwy 5 North, Bryant, AR 72022.   Jesus Lares was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 314658568, citation number 1, item number 2, and was affirmed as a final order on September 28, 2011, with respect to a workplace located at 10470 Kittredge Street, Commerce City, CO 80022.    Jesus Lares Roofing was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 313722019, citation number 1, item number 2, and was affirmed as a final order on December 23, 2011, with respect to a workplace located at 3103 Elkview Drive, Evergreen, CO 80221.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails do not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access:  a) The employer does not ensure that employees use a properly positioned extension ladder when accessing the roof.  This condition was most recently observed at an existing residential jobsite, 95 West Claire, Meridian ID, on April 28, 2015.  Employees used a 16 rung extension ladder positioned at the peak of the rake edge of the roof.      Jesus Lares was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 314658568, citation number 1, item number 3, and was affirmed as a final order on September 28, 2011, with respect to a workplace located at 10470 Kittredge Street, Commerce City, CO 80022.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, are not withdrawn from service until repaired:  a) The employer does not ensure that employees use serviceable ladders.  This condition was most recently observed at an existing residential jobsite, 95 West Claire, Meridian ID, on April 28, 2015.  The bottom rung of a 16 rung extension ladder was bent and misplaced from the ladder side rail.    Jesus Lares Roofing was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.1053(b)(16), which was contained in OSHA inspection number 313722019, citation number 1, item number 3, and was affirmed as a final order on December 23, 2011, with respect to a workplace located at 3103 Elkview Drive, Evergreen, CO 80439.

29 CFR 1926.1060(a)(1)(iii): The employer did not ensure that each employee had been trained by a competent person in the proper construction, use, placement, and care in handling of all stairways and ladders:  a) Residential jobsite: On April 28, 2015 and at times prior thereto employees did not recognize that an extension ladder that was re-positioned for employee use was damaged, uneven, unsecured, and did not extend 3 feet above the roofs edge.
