29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:    a)  On or about 04-29-15, the employer failed to provide safety training such as fall protection and ladder safety prior to an employee working on a second floor deck using a ladder to access the upper landing surface.  The employee was not using fall protection equipment and was not following manufacturer's recommendations in the use of the ladder.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a)  On or about 04-29-15 at Moon Shadow Drive in Greenville, employees were installing residential second floor decking with unprotected sides and edges ten (10) and eleven (11) ft. above surface level without utilizing conventional fall protection equipment.    The Steve Fischer Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 86505 (312559008), citation number 02, item number 001 and was affirmed as a final order on 12-23-10, with respect to a workplace located at 1418 Angels Drive; Ledgeview, WI  54311.    The Steve Fischer Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 89522 (315288290), citation number 01, item number 001 and was affirmed as a final order on 09-27-11, with respect to a workplace located at Prairie Village; Fond du Lac, WI  54935.

The Steve Fischer Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(13), which was contained in OSHA inspection number 86297 (312560386), citation number 01, item number 002 and was affirmed as a final order on 04-26-2011, with respect to a workplace located at Evergreen Drive; Appleton, WI  54914.
