29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:    On or about May 5, 2015, employees were exposed to fall hazards of approximately 12 feet in height to the paved ground below from climbing the scaffold end frames and cross braces to access the scaffold while performing brick laying on a residential home under construction.

Such activities were not performed by experienced and trained employees selected for such work by the competent person:  On or about May 6, 2015, employees were exposed to fall hazards of 12 feet in height to the unpaved ground below when performing brickwork from a scaffold that was missing: planks, a ladder for access, guardrails; had frame poles bear on a foundation that was not firm, and not being trained by a competent person on scaffold erection.
