29 CFR  1926.102(a)(1):The employer did not ensure employees used eye and face protection equipment when machines or operations presented potential eye or face injury from physical agents:  (a)Eduardo Rodriguez at 3409 8th Avenue Southeast, Watertown, SD 57201: On and about or at times prior to October 23, 2024, the exposing employer did not ensure employees were protected from struck-by hazards in that employees operating pneumatic nail guns did not use appropriate eye protection. Operation of pneumatic nail guns can cause significant eye injury including severe vision loss and blindness. Nail gun injuries can cause severe ocular trauma directly, via ricochet after striking a hard surface or metal, or the gun might backfire or jam.

(a)Eduardo Rodriguez at 3409 8th Avenue Southeast, Watertown, SD 57201: On and about or at times prior to October 23, 2024, the exposing employer did not ensure employees were protected from falls from elevation to a lower surface when using a personnel basket lacking a front guardrail in conjunction with a Lull telehandler to access and egress from the roof of the building during roofing work. The personnel basket lacked a front guardrail and employees did not utilize personal fall arrest systems when in the basket. This condition exposed employees to falls up to 37 feet above the ground.
