OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from crushing hazards:  a) North Tower at 15 South 9th St., Newark NJ  An employee did not follow company procedures when dropping an elevator, thus cutting the elevator cables in the elevator shaft versus the cutting the cables in the elevator mechanical room.  Violation occurred on or about 5/5/2015.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:    a) Job site at 15 South 9th St., Newark, NJ    Employees performed demolition work by dropping elevators without receiving training or instruction in recognizing the hazards and unsafe conditions presented by the counter weight, elevator, cables and debris.    Violation occurred on or about 5/4/2015. 29 CFR 1926.850(a): An engineering survey was not performed by a competent person to determine the conditions of the framing floors and walls and the possibility of unplanned collapse of any portion of the structure prior to permitting employees to start demolition operations:    a) Job site at 15 South 9th St., Newark, NJ    Employees performed demolition work by dropping two elevators in the Compass Building & one elevator in the North Tower without conducting an engineering survey.    Violation occurred on or about 5/4/2015.
