29 CFR 1926.501(b)(13):   "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  On 5/6/2015, workers from Cheltenham Construction Services, Inc. were sheathing a roof of a two story residence located on Lot 48, Castle Lake Court, St. Charles MO.  They were not utilizing guardrail systems, a safety net system, or personal fall arrest systems or complying with the company fall protection plan.  The employees were working a roof pitch greater than 9/12 with improperly constructed slide guards; the slide guards were approximately 1 ½ inches high.  Per the company fall protection plan, slide guards are to be constructed of no less than nominal 3 ½ inch height capable of limiting the uncontrolled slide of workers.   Cheltenham Construction Services was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 902001, citation number 1, item number 2, group b issued on 5/21/2013, and was affirmed as a final order on 4/11/2014, with respect to a workplace located at 8432 Delcrest Drive, Saint Louis, MO 63124.
