29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: Employees performing roofing work at 4715 N. Prestwick Ave., Bel Aire, Kansas were exposed to slip and trip hazards from the roof to the ground below in that the aluminum extension ladder did not extend above the eave at least three feet.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: Employees performing roofing work on the new construction, single story building at 4715 N. Prestwick Ave., Bel Aire, Kansas were exposed to fall hazards of 9 feet 4 inches to the ground below in that employees were not protected from falls on the 6 in 12 pitch roof. Dionicio Lara Briano was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 315088534, citation number 01, item number 001 and was affirmed as a final order on 08/26/2011, with respect to a workplace located at 201 S. Cedarwood Dr., Rose Hill, Kansas. Dionicio Lara Briano was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 314029166, citation number 01, item number 002 and was affirmed as a final order on 09/17/2010, with respect to a workplace located at 3957 N.
