29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system:    a) Solterra Sub-division: On May 8, 2015 and at times prior thereto, the controlling employer Tahoe Homes, LLC, did not ensure that its sub-contractor took the proper precautions to protect their employees from fall hazards.  The sub-contractors employees were exposed to a 19 foot fall hazard while performing framing activities from the exterior top plate and unsheathed roof trusses.      b) Solterra Sub-division: On May 8, 2015 and at times prior thereto, the controlling employer Tahoe Homes, LLC, did not ensure that its sub-contractor took the proper precautions to protect their employees from fall hazards.  The sub-contractors employees were exposed to a 13 foot fall hazard to the outside while performing framing activities near unguarded wall/window openings and an 8 foot fall hazard inside to the lower level.      Note) Certification and documentation of corrective action ARE required for this item.

29 CFR 1926.20(b)(2): The employer does not initiate and maintain a safety program which provides for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employer:    a) The controlling employer, Tahoe Homes, LLC, does not perform frequent and regular safety inspections of the jobsites under their control.  They do not have a system to identify, correct, and/or minimize hazards to which employees and their sub-contractors employees are exposed to.  Hazards include but are not limited to, unguarded floor and wall openings, temporary handrails not installed on stairways, not utilizing personal fall protection, and using unguarded power tools. These conditions were most recently observed at 1921 North Justine Ave on May 8, 2015.     Tahoe Homes, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 461944, citation number 1, item number 1b, and was affirmed as a final order on August 24, 2012, with respect to a workplace located at Lot 16, Block 1, 5072 East Mill Station Drive, Boise, ID 83716.    Note) Pursuant to 29 C.F.R. 1903.19, the employer must submit certification AND documentation describing the steps being taken to ensure compliance, including a description of how these steps protect employees and the employees of its sub-contractors from common, obvious hazards.

29 CFR 1926.304(h)(1): Each circular crosscut table saw is not guarded by a hood which would meet all the requirements of paragraph (i)(1) of this section for hoods for circular ripsaws:    a) The controlling employer, Tahoe Homes, LLC, does not ensure that its sub-contractors protect their employees by providing safe tools for use.  The framing sub-contractor does not provide the proper guard on the Bosch 10 inch table saw.  This condition was most recently observed at 1921 North Justine Ave on May 8, 2015.     Tahoe Homes, LLC was previously cited for a violation of this occupational safety and health standard, or its equivalent standard, 29 CFR1926.304(d)(i)(1), which was contained in OSHA inspection number 519715, citation number 1, item number 1d, and was affirmed as a final order on August 24, 2012, with respect to a workplace located at Lot 4, Block 1, 5072 East Mill Station Drive, Boise, ID 83716.    Note) Pursuant to 29 C.F.R. 1903.19, the employer must submit certification AND documentation describing the steps being taken to ensure compliance, including a description of how these steps protect its employees and the employees of its sub-contractors from common, obvious hazards.
