OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck-by and crushed-by hazards while operating the Case 75XT skid steer: a. On or about May 13, 2015, at the PARR2811 4-911 lease site, one mile north of Byron, OK, the employer does not ensure safety devices such as the ROPS (operator presence switch) for the Case 75XT Skid Steer (#7440) are operable. b. On or about May 13, 2015, at the PARR2811 4-911 lease site, one mile north of Byron, OK, the employer does not ensure an employee does not wear loose clothing while performing maintenance activities near rotating parts of a Case 75XT skid steer. c. On or about May 13, 2015, at the PARR2811 4-911 lease site, one mile north of Byron, OK, the employer does not ensure an employee performing maintenance activities on a Case 75XT Skid Steer (#7440) chocked the wheels before beginning the maintenance work.
