29 CFR 1926.1101(f)(1)(ii): Determinations of employee exposure were not made from breathing zone air samples that were representative of the 8-hour time weighted average and 30-minute short-term exposures for each employee:  a)  Worksite at 15 South 9th St., Newark, NJ; United Medical Center North Tower  Air samples for asbestos exposure were collected without a record of who was monitored or what tasks the individual performed.  Sampling was conducted on different individuals daily, rather than by what an individual was doing.  Results could not be used to evaluate whether the samples were representative of exposure.  On 5/19/15, 5/20/15 and 5/21/15 the only recorded sample description was 7th Floor Cleanup. On 5/22/15 and 5/26/15 the only recorded sample description was 7th Floor Removal. On 5/26/15 and 5/27/15 the only recorded sample description was 6th Floor Cleanup. On 5/28/15 the only recorded sample description was 6th floor Cleanup, Wrap, Cut. On 5/29/15, the only recorded sample description was 6th Floor Cleanup & Glovebag. On 6/1/15 and 6/3/15 the only recorded sample description was 5th Floor Cleanup. On 6/4/15 and 6/5/15 the only recorded sample description was 5th Floor Cleanup and Glovebag. On 6/8/15, 6/9/15 and 6/10/15 the only recorded sample description was 4th Floor Cleanup. On 6/11/15, the only recorded sample description was 4th Floor Cleanup & Removal.  Violation occurred on or about 6/18/15.

29 CFR 1926.1101(o)(3)(i)(D): The competent person did not supervise all employee exposure monitoring required by 29 CFR 1926.1101(o) and ensure that it is conducted as required by 29 CFR 1926.1101(f):  a)  Worksite at 15 South 9th St., Newark, NJ; United Medical Center North Tower  The competent person failed to ensure samples were representative of employee exposure and were properly collected and labeled.  Air samples for asbestos exposure were collected between 5/19/15 and 6/15/15 without a record of who was monitored or what tasks the individual performed.  Sampling periods were estimated rather than recorded as pump start and stop times.     Violation occurred on or about 6/18/15.

29 CFR 1926.1101(i)(1): The employer did not provide and require the use of protective clothing, such as coveralls or similar whole-body clothing, head coverings, gloves, and foot coverings for each employee exposed to airborne concentrations of asbestos that exceed the time weighted average and/or excursion limit in 29 CFR 1926.1101(c) or for which a required negative exposure assessment was not produced:  a)  Worksite at 15 South 9th St., Newark, NJ; United Medical Center North Tower  The employer did not require asbestos workers removing over 25 linear feet of thermal system insulation to wear the hoods and booties provided on their coveralls. Asbestos containing pipe fitting insulation was estimated to be present in at least 500 locations on each of ten levels of the building.  Violation occurred on or about 6/18/15.
