29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provide for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person.   a) At the site 4469 Grand Lakeside in Palm Harbor, FL, employees were observed exposed to a fall hazard while installing residential roof sheathing without a competent person to ensure the correct installation and use of fall protection equipment on or about 6/12/2015.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    (a)  On the roof employees were exposed to a 12 foot fall from the 6/12 pitch roof, in that, the employer failed to ensure the use of fall protection on or about 6/12/2015.   The Merval Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1004736, citation number 01, item number 001 and was affirmed as a final order on 12/04/2014, or 15 working days after citation delivery, with respect to a workplace located at 13909 Collier Rock Place (Lot 5, Block 11), Riverview, FL 33579.   The Merval Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1010958, citation number 01, item number 001 and was affirmed as a final order on 1/2/2014, or 15 working days after citation delivery, with respect to a workplace located at 11210 Southwind Lake Drive in Gibsonton, FL 33534.   The Merval Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1012258, citation number 01, item number 001 and was affirmed as a final order on 12/4/2014, or15 working days after citation delivery, with respect to a workplace located at 12227 Fawn Brindle Drive  in Riverview, FL 33569.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a. At the site located on 4469 Grand Lakeside, Palm Harbor FL, employees were performing roof sheathing work on a residential structure while standing 11-ft above the ground without any means of fall protection. No employee training had been provided on or about 6/12/2015.   The Merval Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1004736, citation number 01, item number 002 and was affirmed as a final order on 12/04/2014, or 15 working days after citation delivery, with respect to a workplace located at Fawn Brindle Dr. in Riverview, FL 33569.
