On or about June 15, 2015, the employee working on the ground removing debris and taking edging from the employee on the roof did not have on a hard hat and was being exposed to head injuries.

29 CFR 1926.502(h)(1)(iii): The safety monitor wan not on the same walking/working surface and within visual sighting distance of the employee being monitored: a. On or about June 15, 2015, roof area, the employee on the front of the home was not protected from falling 8 feet or higher to the ground because the safety monitor was only watching the employee on the back side of the home that was cutting metal with a saw. The safety monitor was sitting at the peak of the roof smoking a cigarette and never turned around to watch the other employee.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support: a. On or about June 15, 2015, front of home, the 22-foot extension ladder used to gain and exit from the roof was not secured to prevent accidental displacement.
