OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injuries from a fall hazard caused by elevating the employees while standing on the forks of a powered industrial truck without benefit of any form of fall protection: a) MRI Flexible Packaging, Bensalem worksite - On or about June 16, an employee was elevated more than four feet above the floor while standing on the forks of a powered industrial truck, fell approximately 6 feet, and was seriously injured. Among other methods, means of feasible and acceptable abatement would be compliance with the vehicle operation manual which states on page 1-6 that transporting and lifting a person is an example of improper use, and ANSI B56.1, 2005, section 4.17 Elevating personnel.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours: a) MRI Flexible Packaging, Bensalem worksite - On or about June 16 at approximately 1615, an employee was injured and admitted to the hospital for two days. The employer did not report the incident until June 22, more than 24 hours after admission.
