29 CFR 1926.451(e)(1): A means of access for scaffold platforms more than 2 feet (0.6 m) above or below a point of access, such as portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used: a) On or about 6/24/15 at a residential new build located at 77 Middlebury Lane, Lancaster, New York; employees were using a ladder jack scaffold, with the scaffold brackets and platform to the outside of the supporting ladders. The employees had to access the platform by climbing the supporting ladders and climbing around the bracket and platform. NO ABATEMENT CERTIFICATION REQUIRED

The platform height was approximately 18 feet and there was no personal fall arrest system in place. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 6/24/15 at a residential new build located at 77 Middlebury Lane, Lancaster, New York; employees were installing shingles on the roof of a 2 story house with a 10 in 12 roof pitch and an eave height of approximately 18 feet. There was no fall protection in use. NO CERTIFICATION ABATEMENT REQUIRED Scott Enterprises Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(11)), which was contained in OSHA inspection number 962430, citation number 1, item number 1 and was affirmed as a final order on 7/2/14, with respect to a workplace located at 41 Riley Meadows, Orchard Park, New York.
