29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 11/26/18 at a work site located at 4685 Southwestern Boulevard, Hamburg, New York; an employee working from a 2nd floor balcony installing Tyvek building wrap. Guardrails on the balcony were removed to fasten the building wrap to the exterior walls. There was no other fall protection in place when the guardrails were removed. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.502(b)(3): Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge: a) On or about 11/26/18 at a work site located at 4685 Southwestern Boulevard, Hamburg, New York; an employee was working from a 2nd floor balcony installing Tyvek building wrap. Guardrails on the balcony were removed to fasten the building wrap to the exterior walls and then put back in place after the building wrap was up. While the employee was removing debris, he fell through a guardrail that had been removed and replaced. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) On or about 11/26/18 at a work site located at 4685 Southwestern Boulevard, Hamburg, New York; employees were working from 2nd floor and 3rd floor balconies installing Tyvek building wrap. Employees removed the guardrails to fasten the building wrap to the exterior walls. Employees were not trained in proper recognition of fall hazards, guardrail installation requirements, and various fall protection methods and procedures when guardrails are removed. ABATEMENT CERTIFICATION REQUIRED
