29 CFR 1926.302(e)(4): Personal protective equipment was not in accordance with subpart E of this part, (eye protection). A). On or about July 7, 2015 an employee was observed operating a Bostich brand, pneumatic angle framing, nail gun to nail off subflooring on the second floor deck and was not protected from flying debris and bent nails by means of eye protection. Employee was bending over while using the nail gun to nail off sub floor.

On or about July 7, 2015, 1 employee performing decking work was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measures, (1) The employer failed to satisfy the section 501(b)(13) requirements, and (2) failed to prove infeasibility/greater hazard and/or failed to develop and implement a satisfactory fall protection plan under 1926.502(k). The employees were exposed to a 16-foot fall hazard
