29 CFR 1910.95(g)(1): "Audiometric testing program."  The employer shall establish and maintain an audiometric testing program as provided in this paragraph by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels.    On or about September 3, 2015; the employer had not established an audiometric testing program for employees in the Raylene parts manufacturing operation. On this date the following employee exposures exceeded the 85 decibel time-weighted average exposure level and had not received audiometric testing:    a. a Raylene operation employee was exposed to occupational noise at an 8-hour time-weighted average of 89.08 decibels during a 440 minute sampling period. Zero exposure was assumed during the 40 minutes not sampled.    b. a Raylene operation employee was exposed to occupational noise at an 8-hour time-weighted average of 92.85  decibels during a 443 minute sampling period. Zero exposure was assumed during the 37 minutes not sampled.    c.  a Raylene operation employee was exposed to occupational noise at an 8-hour time-weighted average of 91.45 decibels during a 441 minute sampling period. Zero exposure was assumed during the 39 minutes not sampled.

29 CFR 1910.132(d): Hazard assessment and equipment selection.  29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:  29 CFR 1910.132(d)(1)(i): Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;  On or about July 16, 2015, the employer had not addressed chemical contact hazards for Telene 1650A and Telene 1650B which include skin irritation, skin absorption and eye damage by performing an appropriate hazard assessment, selecting protective equipment and requiring employee use of the appropriate equipment. Employees have not been provided appropriate equipment for protecting the eyes, hands, arms and torso from skin contact with these chemicals.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  On or about July 16, 2015, the employer had not documented and certified the workplace hazard assessment for personal protective equipment.

29 CFR 1910.147(c): General -  29 CFR 1910.147(c)(4): Energy control procedure.  29 CFR 1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:  On or about July 16, 2015, the employer had not developed, documented and implemented energy control procedures for the control of hazardous energy (lockout/tagout) for equipment associated with the Raylene operation, including the Raylene press. During covered activities, employees have potential exposure to multiple stored energy sources including mechanical energy associated with press components in a raised, or upright/elevated position, hydraulic pressure, thermal energy and electrical energy power sources for the equipment components.
