29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:   a)  Mary Lane, Springside at Robbinsville, Robbinsville, NJ: On or about July 16, 2015, High Quality Builders, Inc., employees were conducting framing activities.  Employees were working under hoisted trusses and were not wearing hard hats.  As such they were exposed to overhead struck-by hazards.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.  a)  Mary Lane, Springside at Robbinsville, Robbinsville, NJ: On or about July 16, 2015, High Quality Builders, Inc. employees were conducting framing activities on a multi-story new construction residence.  The rails of the ladder used to access the upper level of the did not extend at least 3 feet above the landing surface.

29 CFR 1926.20(b)(2): Frequent and regular inspections of the job site, materials, and equipment to be conducted by a competent person designated by the employer was not provided by the employer who was responsible to initiate and maintain an accident prevention program:     a)  Mary Lane, Springside at Robbinsville, Robbinsville, NJ: On or about July 16, 2015, the employer, High Quality Builders, Inc., had not initiated a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition.  As such employees were conducting framing activities without proper use of fall protection.  Additionally, ladders used to access the structure were not properly set up, framers without hard hats working under hoisted trusses were exposed to overhead struck-by hazards and workers using nail guns without safety glasses were exposed to potential eye injury.              High Quality Builders, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1058961, citation number 1, item number 1 and was affirmed as a final order on 07/06/2015, with respect to a workplace located at Dickman Dr. & Pershing Blvd Lavallette, NJ.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

The employee was not wearing safety glasses and was thus exposed to potential eye injury.              High Quality Builders, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1058961, citation number 1, item number 2 and was affirmed as a final order on 07/06/2015, with respect to a workplace located at Dickman Dr. & Pershing Blvd Lavallette, NJ. 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  a)  Mary Lane, Springside at Robbinsville, Robbinsville, NJ: On or about July 16, 2015, High Quality Builders, Inc., employees were conducting framing activities without proper use of fall protection. Workers were using the second story wall top plate as their walking/working surface while setting roof trusses.  The employees were exposed to a fall hazard of greater than 20 feet to the ground below.            High Quality Builders, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1060058, citation number 2, item number 1 and was affirmed as a final order on 03/27/15, with respect to a workplace located at 7 Herbert Avenue Pehala Park, Long Beach Township NJ.  High Quality Builders, Inc. was previously cited for a REPEAT violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1058961, citation number 2, item number 1 and was affirmed as a final order on 07/06/2015, with respect to a workplace located at Dickman Dr. & Pershing Blvd Lavallette, NJ.

Workers were using the second story wall top plate as their walking/working surface while setting roof trusses.  The employees were exposed to a fall hazard of greater than 20 feet to the ground below.  The employer did not train  the employees exposed to fall hazards to recognize the hazard and the procedures to minimize these hazards.            High Quality Builders, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1057314, citation number 1, item number 2 and was affirmed as a final order on 7/6/15, with respect to a workplace located at 1 Sunset Drive Tinton Falls, NJ 07724   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
