On or about July 17, 2015, in E row, an employee operating a Caterpillar sit-down type of powered industrial truck (model: E6500; S/N: A4EC120780) with the load trailing was not looking in the direction of, and keeping a clear view of the path of travel when the employee struck and injured another employee picking product at bin E036/E037.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a. In the warehouse where powered industrial trucks were used on all three shifts, the employer did not ensure that powered industrial trucks were examined after each shift.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5): a. In the warehouse, the employee who operated powered pallet jacks including the electric Caterpillar Walkie End-Rider pallet jack (model: WR6000) and who was injured during the powered industrial truck accident on or about July 17, 2015, had not received a combination of formal instruction, practical training, and evaluation of the operator's performance in the workplace. Coca-Cola Refreshments USA, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.178(l)(1)(ii), which was contained in OSHA inspection number 1014782, citation number 1, item numbers 2 through 6 and was affirmed as a final order on April 16, 2015, with respect to a workplace located at 118 Moonachie Avenue, Carlstadt, NJ.
