29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared:  a) Zumrut Marble & Granite - On or about August 14, 2015, the employer did not establish a valid baseline audiogram for an employee grinding and polishing marble who was exposed to continuous noise at 124% of the daily noise exposure limit of 90 dBA or an eight hour time weighted average of 91.5 dBA.  This exposure was observed over a 458 minute sampling.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.

ABATEMENT NOTE: By this date the employer must either correct the alleged violation or implement a Fire Safety Policy, as outlined in 29 CFR 1910.38(a) and (b) which included the evacuation requirement of 29 CFR 1910.157(b).

The employer did not institute a training program and ensure employee participation in the program:  a) Zumrut Marble & Granite - On or about August 14, 2015, an employee grinding marble and granite with handheld grinding and polishing tools was exposed to continuous noise at 124% of the daily permissible exposure llimit of 90 dBA or an eight hour time weighted average of 91.5 dBA, and the employer did not institute a training program to ensure that the exposed employee was adequately trained in the hazardous effects of noise.   Zumrut Marble & Granite was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.95(k)(1), which was contained in OSHA inspection number 401163, citation number 1, item number 2 and was affirmed as a final order on August 8, 2012, with respect to a workplace located at 2224 Industrial Dr., Bethlehem, PA, 18017.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
