OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to health hazards associated with an uncontrolled release of sodium hypochlorite solution (bleach): a) Tank Truck Loading Area (Bleach Product Process Equipment) - On or about August 14, 2015, employees were exposed to an uncontrolled release of approximately 10,000 gallons of 15% sodium hypochlorite from a failed plastic pipe fitting. The employer identified an intermittent leak in a glued joint on a cross fitting. A work order was generated on May 2, 2015, but the employer deferred corrective action ;until a planned outage in October 2015. The cross fitting failed due to a pressure spike caused by rapid closure of the loading valve on August 14, 2015. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices: (a) Tank Truck Loading Area (Bleach Product Process Equipment) - The employer did not instruct employees, exposed to concentrated sodium hypochlorite solution (bleach), on appropriate work practices, such as a routine maintenance schedule that communicates specific procedures for prioritizing the prompt repair and replacement of deficient process equipment such as defective PVC piping and fittings. On or about August 14, 2015. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
