29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. Employees performing residential framing work at elevations of six feet or more above the ground are not protected from fall hazards by a fall protection system. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on August 17, 2015, when employees were installing framing from the floor decking of a two-story residential building at 130 Sandy Beach Lane, Atlantic Beach, Florida 32233 without fall protections and were exposed to fall hazards of 9 feet 5 inches above the concrete foundation and surrounding ground. Malagon Framing, LLC previously committed a Serious violation of this standard on October 1, 2014, when employees were installing framing from the top of a structure at 724 W. Kings College Drive, Saint Johns, Florida 32259, which became a Final Order on April 3, 2015. (Inspection No. 997772)

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a. On or about August 17, 2015, at the second floor decking of the residential building, employees performing framing work 6 feet or more above ground were not properly trained in the use of personal fall arrest systems.
