On or about September 30, 2015, employees were operating DeWalt brand circular saws, and Milwaukee brand Saw-zall power tools and were not protected from electrical ground fault hazards because the ground pin on the flexible extension cords was removed/broken off.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    a). On or about September 30, 2015, CSHO observed employees using pneumatic nail guns throughout the project and were not protected from eye injuries because they were not wearing eye protection while using pneumatic powered nail guns.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures.    a: On or about September 30, 2015, Employees were completing construction tasks in and around a new one story residential structure and were exposed to several trip and fall hazards, and impalement hazards because the employer did not maintain a job site free from scrap lumber with protruding nails, and all other debris.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a). An employee performing residential framing work at elevations of six feet or more above the ground is not protected from fall hazards by a fall protection system.    The employer did not assure effective protection against falls as required by the standard, as demonstrated on September 30, 2015, when an employee was nailing the sheathing to the roof of a one story residential project walking on a 5 pitch roof system at lot #86 at 13001 Pechora Court, the Tamaya Complex, Jacksonville, Florida without fall protection and was exposed to a fall of more than 12 feet to the ground below.    Malagon Framing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 997772, citation number 1, item number 1 and was affirmed as a final order on 12/1/2014, with respect to a workplace located at 724 W. Kings College Drive, Saint Johns, FL 32259.
