29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. WORKSITE: The employees, covering the open tops of the trailers with tarps from the top of the trailers were not protected from the hazard of falling by the use of appropriate fall protection systems/devices.

29 CFR 1910.23(e)(1): A standard railing shall consist of top rail, intermediate rail, and posts, and shall have a vertical height of 42 inches nominal from upper surface of top rail to floor, platform, runway, or ramp level. The top rail shall be smooth-surfaced throughout the length of the railing. The intermediate rail shall be approximately halfway between the top rail and the floor, platform, runway, or ramp. The ends of the rails shall not overhang the terminal posts except where such overhang does not constitute a projection hazard. WORKSITE: The open-sided platform on the commercial trailer, Model: AWO45100, VIN: 1S9WA45215S188801, was not guarded by a standard guard rail system.

29 CFR 1910.27(f): "Maintenance." All ladders shall be maintained in a safe condition. All ladders shall be inspected regularly, with the intervals between inspections being determined by use and exposure. WORKSITE: The employer did not ensure through performing regular inspections that the fixed ladder on the commercial trailer, Model: AWO45100, VIN: 1S9WA45215S188801, and used by employees to access the top of the trailer was maintained in a safe condition at all times. On or about September 02, 2015, the handhold of the above fixed ladder broke off while an employee was in the process of descending the ladder, and the employee fell approximately 9 feet to the ground.
