OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees performing window washing activities did not have the roof riggers tied back to an anchor point:  (a)  On or about September 9, 2015 at the 631 Hazel Street, Oshkosh, WI jobsite; The Rooftop Roller Suspended Solutions (no model or serial number) did not have the six 43 lb Suspended Solutions counterweights on prior to performing drop work.  This exposed employees to fall hazards.  (b)  On or about September 9, 2015 at the 631 Hazel Street, Oshkosh, WI jobsite; an independent tie back safety line was not utilized while employees were performing window washing activities from The Rooftop Roller Suspended Solutions (no model or serial number) exposing employees to fall hazards.  (c)  On or about September 9, 2015 at the 631 Hazel Street, Oshkosh, WI jobsite; an independent tie back safety line was not utilized while employees were performing window washing activities from MIO Mechanical Corporation Portable Roof Rigger (Model:  MRR250A-2x8, S/N:  3524) exposing employees to fall hazards.

29 CFR 1910.28(j)(4): The worker was not protected by a safety life belt attached to a lifeline securely attached to substantial members of the structure (not scaffold) or to securely rigged lines, which would safely suspend the worker in case of a fall:   (a)  On or about September 9, 2015 at the 631 Hazel Street, Oshkosh, WI jobsite; while using The Rooftop Roller Suspended Solutions (no model or serial number) lifelines were not utilized to a substantial member of the structure or rigged lines on the mechanical/penthouse while performing dropping activities.  This exposed employees to fall hazards.  (b)  On or about September 9, 2015 at the 631 Hazel Street, Oshkosh, WI jobsite; while using MIO Mechanical Corporation Portable Roof Rigger (Model:  MRR250A-2x8, S/N:  3524) lifelines were not utilized to a substantial member of the structure or rigged lines on the mechanical/penthouse while performing dropping activities.  This exposed employees to fall hazards.
