OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to strike-by hazards:  a) Plant - On or about 10/29/15 and at times prior thereto employees loosened and displaced the raw material hoppers of injection molding machines #1 to #8 during maintenance, service and clean-up. The loose hoppers were not secured to prevent accidental  tilting on the workers.   b) Plant - On or about 10/29/15 and at times prior thereto employees conducted maintenance, servicing, and clean-up of injection molding machines.  The row material hoppers of machines #5, #6, #7 were installed unsafely with only two bolts instead of four, as required by the design of the equipment.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards : Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard:  a) Plant - On or about 10/29/15 and at times prior thereto employees climbed on top of the injection molding machines including (but not limited to) machines #5, #6, #7 and #8 to change molds and conduct maintenance/repairs. No fall protection was in use to prevent falls from a maximum elevation of 12 ft. onto the concrete floor.  Or in the alternative:  29 CFR 1910.23(c)(3): Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards were not guarded with a standard railing and toe board.  a) Plant - On or about 10/29/15 and at times prior thereto employees climbed on top of the injection molding machines including (but not limited to) machines #5, #6, #7 and #8 to change molds and conduct maintenance/repairs.
