29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposed an employee to injury, was not guarded: The employer is failing to protect employees from amputation hazards associated with operating machinery where the point of operation guarding is missing. This most recent occurrence of this was evident during the inspection of facility located at 4657 G Street, Omaha, NE where the employer has employees tasked to prime the blue line icing machine by packing icing into the intake side of the pump with the screen guard removed thus exposing the employee to the turning gears and an amputation hazard as was the case in this incident.

29 CFR 1904.29(b)(3): Recordable injuries and illnesses shall be entered on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness has occurred: The employer failed to enter a recordable injury on the OSHA 300 log and to fill out a 301 Incident Report within seven (7) days of an accident occurring. This most recent occurrence of this was evident during the inspection of facility located at 4657 G Street, Omaha, NE where on October 22, 2015 the employer had a maintenance employee identified as case number 59-15; injured while making repairs to the chain and sprocket guard on the conveyor belt system for the clamshell closer, resulting in amputation to one finger and lacerations to three others. The employer did not record the incident on the OSHA 300 log until October 31st.

The employer has failed to report a workplace incident resulting in the amputation of an employees finger.
