OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. At the jobsite, on or about 11/5/15: A rough terrain forklift operator was driving in proximity to employees on foot. The operator did not yield the right of way to pedestrians and struck an employee with one of the forklift's wheels. The pedestrian received a fractured leg. Abatement certification must be submitted for this item.
