OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer did not mark storage racks with the intended load and did not repair storage racks.   On 11/13/15, in the warehouse area, the employer did not meet provisions listed in consensus standard ANSI MH16.1: 2008 Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks  in that storage racks used for product were not marked with the maximum load and were not repaired when damage was incurred.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
