29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part.    a)  Overland Park Apartments:  On or about November 16, 2015, and at times prior thereto, the employer had not developed and/or implemented an accident prevention program to address hazards to which their employees and/or the employees of subcontractors are exposed. Hazards include but are not limited to falls from the lack of hand railing in stairwells, unguarded decks and/or framing activities at elevated heights without the use of fall protection, fire hazards while employees were observed smoking in the wood structures without fire suppression equipment in place, misuse of ladders and/or overhead hazards.     Note: Abatement certification IS required for this item.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:   a) Overland Park Apartments:  On or about November 16, 2015, and at times prior thereto, the employer did not perform effective frequent and regular inspections of sites that they controlled to identify, correct and/or eliminate hazards to which their employees and/or the employees of subcontractors were exposed.  Hazards include but are not limited to falls from the lack of hand railing in stairwells, unguarded decks and/or framing activities at elevated heights without the use of fall protection, fire hazards while employees were observed smoking in the wood structures without fire suppression equipment in place, misuse of ladders and/or overhead hazards. 29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    a) Overland Park Apartments:  On or about November 16, 2015, the controlling employer, Ramsey Construction LLC did not ensure that its sub-contractors protected their employees while they accessed decks without a completed guardrail system was not in place.  Employees were exposed to a 10 foot 6 inch fall hazard from the second floor balcony and/or an approximate 20 foot fall from the third level balcony to the ground level below.
