29 CFR 1910.95(i)(2)(ii)(A): The employer did not ensure that hearing protectors are worn by any employee who is exposed to an 8-hour time-weighted average of 85 decibels or greater and has not yet had a baseline audiogram established pursuant to 29 CFR 1910.95(g)(5)(ii):  (a) Between June 2, 2015 and January 14, 2016 the employer failed to ensure that hearing protectors were worn by any employee who was exposed to an 8-hour time-weighted average of 85 decibels or greater who had not yet received a baseline audiogram, in that use of hearing protection was not enforced.   (1) A brake operator employee was exposed to continuous noise levels of approximately 93.2 dBA, or 155.2% of the dose, exceeding an 8-hour time-weighted average sound level of 85 dBA. The sampling was performed for 475 minutes during one shift on January 14, 2016; exposure calculations included a zero increment for the 5 minutes not sampled.  (2) A utility driver employee was exposed to continuous noise levels of approximately 90.9 dBA, or 114% of the dose, exceeding an 8-hour time-weighted average sound level of 85 dBA. The sampling was performed for 473 minutes during one shift on January 14, 2016; exposure calculations included a zero increment for the 7 minutes not sampled.  (3) A machine operator employee was exposed to continuous noise levels of approximately 87.8 dBA, or 74% of the dose, exceeding an 8-hour time-weighted average sound level of 85 dBA. The sampling was performed for 448 minutes during one shift on January 14, 2016; exposure calculations included a zero increment for the 32 minutes not sampled. 29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k):  (a) Between June 2, 2015 and January 14, 2016 the employer failed to train each employee who is exposed to an 8-hour time-weighted average of 85 decibels or greater in accordance with the requirements of 29 CFR 1910.95(k), in that employees included in the hearing conservation program did not understand that hearing protection was mandatory, and that personally owned earphones do not provide effective hearing protection in the work place.  (1) A brake operator employee was exposed to continuous noise levels of approximately 93.2 dBA, or 155.2% of the dose, exceeding an 8-hour time-weighted average sound level of 85 dBA.
