29 CFR 1910.95(d)(1)(ii): When information indicates that any employee's exposure may equal or exceed an 8-hour time-weighted average of 85 decibels, the employer shall develop and implement a monitoring program. Where circumstances such as high worker mobility, significant variations in sound level, or a significant component of impulse noise make area monitoring generally inappropriate, the employer did not use representative personal sampling to comply with the monitoring requirements of 29 CFR 1910.95(d): On or about June 7, 2016, the employer had failed to conduct representative personal noise sampling to comply with the monitoring requirements of 29 CFR 1910.95(d), when information indicated that employee exposures may equal or exceed an 8-hour time-weighted average of 85 decibels. (a) A grinder operator employee was exposed to continuous noise levels of approximately 93.2 dBA, or 159.9% of the dose, exceeding an 8-hour time-weighted average sound level of 85 dBA. The sampling was performed for 485 minutes during the 12 hour shift on June 16, 2016.
