OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while using improperly maintained mobile ladder stands.    a) Unger & Company, Spray Dry Room - On or about January 27, 2016, a mobile ladder stand being used by employees was not properly fitted with the rubber pad safety stops required to prevent horizontal movement when the ladder was in use.    ABATEMENT NOTE:  Among other methods, one feasible and acceptable abatement method to correct this hazard is: Comply with the manufacturer's requirements and ANSI A14.7-1991 for Mobile Ladder Stands and discontinue use until repairs are completed. Section 4.3.7 states, "Units which use wheels or casters, ridged and / or swivel, shall be equipped with a system to prevent the unit from horizontal movement". Section 6.3 also states, "Units that are damaged or weakened from any cause shall not be used until repairs are completed",  Units that are damaged subsequent to their receipt, and/or are worn beyond repair shall be destroyed. Never climb a damaged ladder stand or ladder".
