OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to struck-by hazards and crushing hazards while working near or with a cement bucket lifted by an alloy steel chain sling attached to the bucket of a front end loader.  a) Throughout the facility, 438 Riverview Road, Lehighton, PA - Employees lifted Gar-Bro "R"-Series round gate lightweight buckets (potential maximum weight of 8,275 lbs) with alloy steel chain slings connected to a D-ring welded to the bucket of a Caterpillar Wheel Loader - Model 938G Series II (Serial No. CAT0938GTRTB01558) which as configured (non-standard) had an unknown rated load capacity exposing employees to struck-by or crushed-by hazards, on or about January 13, 2016.  In accordance with 29 CFR 1903.19(c), abatement certification is required for the violation.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval.  a) Throughout the facility, 438 Riverview Road, Lehighton, PA - Employees transported materials with the Caterpillar Lift Truck Model DP150 (Serial No. 6DP10025), such as but not limited to palletized materials, Gar-Bro "R"-Series round gate lightweight buckets, and cement products, with forklift tines that had holes drilled near the tips exposing employees to struck-by or crushed-by hazards, on or about January 13, 2016.  In accordance with 29 CFR 1903.19(c), abatement certification is required for the violation.
