29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s) (a) MCC, LTD, 8200 Sheridan Street, Westminster, CO 80003: On or about January 14th, 2016, the controlling employer in charge of the worksite had not ensured a competent person inspected the pumpjack scaffold system on the South side of the apartment building prior to use. The scaffold system was missing guardrails to prevent falls and bracing on the bottom portion of the three vertical scaffold poles to prevent displacement. Condition exposed the subcontractors employees to an estimated fall hazard of 16 feet. (b) MCC, LTD, 8200 Sheridan Street, Westminster, CO 80003: On or about January 14th, 2016, the controlling employer in charge of the worksite had not ensured a competent person conducted an inspection of the worksite to identify overhead hazards requiring the use of hard hats. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
