Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to the hazard of being crushed: a) On or about January 27, 2016, employees were exposed to crushing hazards in the event of a roll-over/tip over created by operating the Hyster lift truck, model # H50XM, serial # H177B51308B without the restraint systems being used. Abatement note: Among other methods, one feasible and acceptable method to correct this hazard would be to enforce the requirement that the operators of the powered industrial truck use seat belts.
