29 CFR 1910.134(f)(2): Employee(s) using a tight-fitting facepiece respirator were not annually fit tested:  a) 400 E. Indian River Rd, Norfolk,VA 23324, Vessel APL-200 and DBL-85: On or about February 10, 2016, and times prior thereto, the employer did not provide a fit-test at least annually for employees who were required to wear a respirator to clean barges that transported hazardous chemicals including but not limited to phenol and unleaded gasoline, potentially exposing employees to eye, skin and respiratory irritation and possible severe acute and chronic disease.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:  a) 400 E. Indian River Rd, Norfolk,VA 23324, Vessel APL-200 and DBL-85: On or about February 10, 2016, and times prior thereto, each employees who was required to wear a respirator to clean barges that transported hazardous chemicals including but not limited to phenol and unleaded gasoline, wore facial hair, potentially exposing employees to eye, skin and respiratory irritation and possible severe acute and chronic disease.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.

Indian River Rd, Norfolk,VA 23324, Vessel APL-200 and DBL-85: On or about February 10, 2016, and times prior thereto, each employee who was required to wear a respirator, and each supervisor, was not retrained when inadequacies such as but not limited to wearing facial hair, indicated that the employee did not retain the requisite understanding of safe respirator use, potentially exposing employees to eye, skin and respiratory irritation and possible severe acute and chronic disease.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(3): The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv):  a) 400 E. Indian River Rd, Norfolk, VA 23324, Vessel APL-200 and DBL-85: On or about February 10, 2016, and times prior thereto, the employer did not provide hazard communication training to include GHS pictograms and labeling requirements and SDS format, where employees worked with hazardous chemicals, such as but not limited to phenol and unleaded gasoline, potentially exposing employees to eye, skin and respiratory irritation and possible acute and chronic disease.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement Note:  Employees shall be informed of the following: 1. The requirements of this section; 2. Any operations where hazardous chemicals are present; 3. The location and availability of the written Hazard Communication Program, list(s) of hazardous chemicals, and Safety Data Sheets.  Employee training shall include at least: 1. Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area. 2. The physical and health hazards of the chemicals in the work area. 3. The measures employees can take to protect themselves such as specific procedures and personal protective equipment to be used. 4. The details of the employer's Hazard Communication Program including an explanation of labeling system, Safety Data Sheets, and how employees can obtain and use the appropriate hazard information.
