29 CFR 1926.602(d):  The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):    29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a)  On or about February 18, 2016, the employer provided employees with a Lull 844C-42 rough terrain forklift without ensuring they were competent to operate the equipment safely, as demonstrated by successful completion of forklift training and evaluation.    No abatement certification or documentation is required for this item.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems:      a)  On or about February 18, 2016, employees were exposed to fall hazards of approximately 15.2 feet while performing carpentry work on a second story deck.      b)  On or about February 18, 2016, employees were exposed to fall hazards of approximately 17 feet while performing carpentry work around unguarded window openings.    Leinster Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 937135, citation 1, item 1, and was affirmed final order on or about September 17, 2013, with respect to a workplace located at 4832 N. Clark St., Chicago, IL, 60607.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.1053(b)(4):  Ladder(s) were used for purposes other than the purpose for which they were designed:    a)  On or about February 18, 2016, employees were exposed to fall hazards while using an a-frame step ladder without its metal spreaders or locking devices in the open position.    b)  On or about February 18, 2016, employees were exposed to fall hazards while using an a-frame step ladder for access and egress between two points; a first level deck, and the second level deck of the building.    Leinster Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(4) which was contained in OSHA inspection number 937135, citation 1, item 3, and was affirmed final order on or about September 17, 2013, with respect to a workplace located at 4832 N. Clark St., Chicago, IL, 60607.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
