29 CFR 1910.120(q)(1): Emergency response plan. An emergency response plan shall be developed and implemented to handle anticipated emergencies prior to the commencement of emergency response operations. The plan shall be in writing and available for inspection and copying by employees, their representatives and OSHA personnel. Employers who will evacuate their employees from the danger area when an emergency occurs, and who do not permit any of their employees to assist in handling the emergency, are exempt from the requirements of this paragraph if they provide an emergency action plan in accordance with 29 CFR 1910.38. A. On or about February 28, 2016, located in the Dimer building, there was a rapid phase change when moisture entered the T911B tank causing the tank to over pressurize and explode. Personnel were not evacuated out of the danger area and were required to assisted in handling the emergency without knowing the condition of the building or the equipment, thereby exposing the employees to a struck-by and/or burn hazard.

29 CFR 1910.165(b)(1): The employee alarm system shall provide warning for necessary emergency action as called for in the emergency action plan, or for reaction time for safe escape of employees from the workplace or the immediate work area, or both. a. On or about February 28, 2016, located in the Dimer building, there was a rapid phase change when moisture entered the T911B tank causing the tank to over pressurize and explode. There was no warning alarm system activated to alert personnel for an evacuation of the area and to prevent personnel from entering the danger area. The employees were exposed to a struck-by and/or burn hazard due to no warning alarm being initiated.
