29 CFR 1910.1200(f)(5): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein: a) 1602 North Brooklyn Road - Employees working near two 55 gallon drums of "EUCON WR 75" were exposed to hazards without containers labeled, tagged, or marked to identify appropriate hazard warning, on or about March 2nd, 2016. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: a) 1602 North Brooklyn Road - Employees used EUCON WR 75 as a mixture for concrete, and the employer did not provide employees with training on the revised hazard communication standard (HCS 2012) label elements and the format and type of information on each section of the safety data sheets (SDSs) to ensure that when employees see HCS 2012 compliant labels and SDSs in their workplace, employees understand how to use the labels and SDSs and access the information, on or about March 2, 2016. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
